BOC-3: designation of process agents
The BOC-3 names a process agent in each state where you operate who can accept legal papers for your company. Carriers with operating authority (MC numbers), brokers and freight forwarders must have one on file.
- It is a one-time filing, not a renewal, usually filed by a process agent company for you.
- FMCSA will not grant operating authority until the BOC-3 is on file.
- If your BOC-3 is cancelled, your authority can be suspended. Keep it active and replace it if your agent company changes.
What missing it can cost
Without a valid BOC-3 on file, FMCSA can suspend your operating authority after a 30-day notice.
